End User License Agreement

This End User License Agreement ("Agreement" or "EULA") is a binding legal agreement between you (the "User" or "you") and the operators of Perennial Software AB ("Company," "we," "us," or "our") governing your use of the Hummock web application, mobile applications, and any associated services (collectively, the "Application").

By downloading, installing, accessing, or using the Application, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install, access, or use the Application.

1. License Grant

Subject to your strict compliance with this Agreement, Perennial Software AB grants you a revocable, non-exclusive, non-transferable, limited license to access and use the Application solely for your personal, non-commercial purposes on compatible devices that you own or control.

To utilize certain features of the Application, such as recording trails and uploading media, you may be required to register an account. You agree to:

3. User-Generated Content (UGC)

The Application allows you to record GPS tracks, write narrative notes, and upload photographs ("User Content").

Ownership: You retain all intellectual property rights in the User Content you submit to the Application.

License to Perennial Software AB: By uploading or submitting User Content, you grant Perennial Software AB a worldwide, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, display, distribute, and modify your content to operate, improve, promote, and develop the Application (including training or running automated feature-detection algorithms for terrain, landmarks, and landmarks context).

Content Restrictions: You agree not to upload content that is illegal, abusive, defamatory, infringes on third-party intellectual property rights, or contains commercial solicitations, spam, or search engine optimization (SEO) manipulation links. We reserve the right to review, flag, modify, or delete any User Content at our sole discretion.

4. Background Location & Data Tracking

The Application includes features that track your geographic location via GPS, including while the Application runs in the background.

Background tracking is subject to hardware limitations, operating system constraints (such as aggressive OS process termination), battery levels, and satellite availability.

Hummock does not guarantee the continuous, uninterrupted, or error-free collection of your GPS trail data. It is your responsibility to monitor your device's battery usage and operational status.

5. Critical Backcountry Safety Disclaimer

THE APPLICATION IS PROVIDED SOLELY FOR MEMORY-DOCUMENTATION, HISTORICAL RECORDING, AND PERSONAL RECREATIONAL PURPOSES. IT IS NOT A LIFE-SAFETY NAVIGATION TOOL.

No Reliance: The GPS tracking, progress traces, topographic approximations, and automated geographical feature labels provided by the Application are indicative only. They may be inaccurate, outdated, or incomplete.

Assumption of Risk: Backcountry navigation (including but not limited to hiking, trekking, and off-trail exploration) involves inherent risks of injury, severe weather exposure, disorientation, and death. You assume 100% of the risk associated with your outdoor activities.

Secondary Navigation: You agree that you will never rely solely on the Application for critical navigation in wilderness areas. You must always carry reliable secondary navigation tools, such as physical topographic maps, a traditional magnetic compass, and dedicated satellite communication devices when entering remote backcountry terrain.

Except for your User Content, all right, title, and interest in and to the Application—including the software, user interface design, branding, algorithms, proprietary spatial indices, and compiled geography databases—are and will remain the exclusive property of Perennial Software AB and its licensors.

8. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PERENNIAL SOFTWARE AB DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PERENNIAL SOFTWARE AB DOES NOT WARRANT THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HUMMOCK, ITS DEVELOPERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

This Agreement is effective until terminated by either you or us. You may terminate this Agreement at any time by deleting your account and discontinuing all use of the Application. We reserve the right to terminate or suspend your license and access to the Application at any time, without prior notice, for any conduct that we believe violates this Agreement or is harmful to other users or the Application.

11. Governing Law

This Agreement and any dispute arising out of or related to it shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the courts located in Gothenburg, Sweden, and you hereby consent to the personal jurisdiction and venue therein.
